CONFIRMATION OF BOOKING

On receipt of a completed Booking Form, the required deposit and travel insurance details we will send a Booking Confirmation for your tour. If booking within 10 weeks (70 days) of the departure date full payment is required at the time of booking. At this point, when the required deposit has been paid in full, travel insurance details received and the booking confirmed, a contract exists between you, as the Person Booking and Wild Tweed Limited trading as Matt Limb Battlefield Tours, based on the information shown on the Booking Confirmation. If you make a telephone booking, email booking or Internet booking and pay the required deposit by this method, the contract exists at the time we receive your deposit payment.

TRAVEL INSURANCE

It is a condition of booking with Matt Limb Battlefield Tours that all clients have adequate travel insurance for the duration of the battlefield tour. Prior to departure, we will request that you provide us with details of your insurers, the policy number and all emergency contact numbers as stated on your policy, only on receipt of such travel insurance information can your booking be confirmed. Under new regulations travel insurance arrangements are regulated by the Financial Services Authority and can longer be provided by Matt Limb Battlefield Tours. However, we will provide advice at the time of booking on a suitable policy.

BALANCE PAYMENTS

The outstanding balance must be paid in accordance with the details on your Booking Confirmation. If full payment is not received by the due date, as shown on the Booking Confirmation, we reserve the right to treat the booking as cancelled and you will lose your deposit.

IF YOU CANCEL THE BOOKING

If you wish to cancel a booking at any point, the person who made the booking, as shown on the Booking Confirmation, must notify us IN WRITING. Cancellation is only effective from the day the letter of cancellation is received at our office. If you cancel more than 42 days prior to departure you will incur the loss of the deposit. After this period, cancellation charges at the rates below will be made before any refund is calculated:

• Over 42 days prior to departure date the deposit only will be charged.

• 28 – 42 days prior to departure date; whichever is the greater – 30% of the tour cost or the deposit paid will be charged.

• 14 – 27 days prior to departure date; whichever is the greater – 65% of the tour cost or the deposit paid will be charged.

• 7 – 13 days prior to departure date; whichever is the greater 85% of the tour cost or the deposit paid will be charged.

• Less than 7 days prior to departure date 100% of the tour cost will be charged.

IF WE CANCEL THE BOOKING

Unless it becomes necessary due to circumstances amounting to force majeure, your booking will not normally be cancelled after the date when payment of the balance becomes due and in this event, you will be informed as soon as possible and offered an alternative tour dates. If the alternative tours are unacceptable, a refund of all monies paid will be given.

IF YOU CHANGE THE BOOKING

Should you wish to alter your booking, in any way after we have confirmed your booking, we will endeavour to carry out your request but no guarantee can be given that the changes will be possible. An administrative charge of £40.00 may be made for any change after the Date of Booking. We also reserve the right to pass on any additional charges levied by airlines, hotels, coach companies or similar organisations that arise out of your changes.

IF WE CHANGE THE BOOKING

When you make your contract with us we will use all our means to ensure that none of the components or elements of your tour have to be altered. However, you must understand that planning many months in advance, our contacts and suppliers sometimes introduce changes that we or our suppliers cannot influence, for example, changes in ferry times and flights, closure of hotels etc. We reserve the right to make any necessary adaptations. Such changes are rarely significant, but if they are you will be notified as soon as possible before departure and given the options of accepting the change(s).

OUR RESPONSIBILITIES

We accept responsibility for ensuring that the services which we contract to provide are supplied and to a reasonable standard unless prevented by circumstances amounting to force majeure, which includes war or threat of war, riot, civil strife, industrial dispute, unforeseeable or unavoidable terrorist activity, natural or nuclear disaster, fire or adverse weather conditions and similar problems beyond our control. We cannot be held responsible for extra costs due to unforeseen delays, industrial disputes, civil riots, accidents and inoperable weather conditions. Any extra cost incurred will be charged to the person making the booking. We will, of course, do all that is possible to protect the traveller’s interests.

FINANCIAL FAILURE INSURANCE

Matt Limb Battlefield Tours are dedicated to providing the very highest level of security for all deposits and payments made in respect of your travel arrangements; so in accordance with ‘The Package Travel, Package Tours Regulation 1992’ all passengers booking with Matt Limb Battlefield Tours are fully insured for the initial deposit and subsequently the balance of all monies paid to us arising from the cancellation or curtailment of your travel arrangements due to the insolvency of Matt Limb Battlefield Tours. A certificate detailing this cover will be given to each and every passenger as evidence of the cover.

TRAVEL DOCUMENTS

All travellers must have a valid passport for travel outside the United Kingdom, please note that passports will be checked as you join the tour. If visas are required you are advised to apply in good time, which varies in different countries. Visa costs are NOT included in the tour price. Non-United Kingdom residents should check their particular visa and passport requirements before booking a tour.

PRICE

Calculation for the prices quoted, for any booking, are based on known costs, exchange rates and other costs in operation at the time of the quotation, and, or booking. It is our policy to offer the best price guarantee possible. Many factors outside our control could affect the cost of a tour but there are only four circumstances under which we reserve the right to impose a surcharge:

(1) transportation costs, including the cost of fuel.

(2) dues, taxes or fees chargeable for services such a landing taxes or embarkation/disembarkation fees at ports and airports.

(3) Government action such as increases in VAT or any other Government imposed increases.

Even then we will absorb the first 3% of the increase, which excludes insurance premiums and any amendment charges. Only amounts in excess of 3% will be surcharged. Notification of any surcharge will be made not less than 30 days prior to your departure date. Any increases after this will be absorbed by us; provided you do not change your tour dates or itinerary and that your account has been paid in full.

LAW AND JURISDICTION

The above Terms and Conditions is an outline agreement and your contract with us which is subject to change without prior notification. Any matters arising from it shall be subject to English Law and to the jurisdiction of the Courts of England.
